As of today denied HAMP loan! Started process in September of last year (2009) Late on payments May 09′- Present Hardship was over 5 months later. Been trying to pay since Sept 2009/ and modify. Applied 3 times this is the first time actually denied. They are looking at a in house (MAp2) Program and will let me know today or monday if I qualify.

OCTOBER 2009
applied for our Loan Modification sending all documents through certified mail. (THIS WAS OUR SECOND TIME HAVING TO SUBMIT ALL OF THE DOCUMENTS DUE TO THE SALE OF INDYMAC TO ONE WEST)
Called regarding status FOR OVER 6 MONTHS with no answer, continued to make payments the best we could. We were 2 months behind due to our explained hardships. Told over phone in FEBRUARY 2010 we were denied.
VERY NEXT DAY in mail was “3 month” HAMP trial loan plan agreement through Indy Mac. We were confused but ecstatic.
FEBRUARY 11TH, 2010:
Brent and I signed “3 month” trial agreement. It states MARCH 1ST, 2010 new payment would be $2418 instead of $5200. It states if we make payments on time, submit paperwork by deadlines, they would not conduct foreclosure sale…..
MAY 2010:
Called Making Home Affordable Act Hotline. I had extreme concerns with conducts of Indy Mac Bank after researching stories of predatory lending accusations in the media, profiting on foreclosures rather than offering loan modifications, and countless blogs of foreclosure horror stories from consumers. We paid ALL trial loan payments on time for 3 months at this point., but loan modification had not been made permanent. The MHA Representative I spoke with was CHRISTINA RACE. Called IndyMac and spoke with Rodell (they do not provide last names at IndyMac)
In 3 way phone conversation, I was assured Permanent loan Mods DO happen. I explained three month trial was finishe yet nothing was happening, nothing was made permanent, and asked what payment was expected at this point. Told by Rodell we would get response soon, and CONTINUE PAYING THE MODIFIED AMOUNT until we receive an answer.
EVERY PHONE CALL AFTER THIS, I WENT THROUGH THE MHA HOTLINE, ENSURING CALLS AND INFORMATION WERE DOCUMENTED.
JUNE 8TH 2010:
Spoke with ROBERT PAINTER Ext 6 with Indy Mac regarding first rejection letter of documents received in the mail. It stated Profit and Loss Statement contained personal expenses under “entertainment” I explained the expense was for food and drinks at business benefit. (it was only $129) There were requests of pay stubs, but we are both business owners.. It asked for copies of monthly disability checks, when I hadn’t received one since 2004, all this was clearly explained in our original application. I wondered if they read these packets? ROBERT PAINTER DISMISSED all the documentation requested in this letter during this phone call..
JUNE 23RD 2010:
Called IndyMac regarding NEW document request letter received in the mail. (mind you, these letters ONLY started coming AFTER 3 month trial period should have ended, there were no document requests during 3 months we were SUCCESSFULLY PAYING ON TIME)
Letter requested “letters of contributions” from renters. (we have 3 story house and rented out 2 to make payments easier) My MHA rep was Jennifer and Indy Mac Rep was VICKI. We provided them with NOTARIZED RENTAL AGREEMENTS from both renters, and bank statemens proving rent money in our original packet..
A supervisor was brought into this call by VICKI (with Indymac) She felt documents sent adequetly proved rental income. Supervisor was ROBERT BELPRANE at ext 2143. (I may have his last name spelled wrong) ROBERT reviewed bank statements and renters agreements on the phone with us, claimed the request for “financial contribution letters” would be dismissed and “NO OTHER DOCUMENTS WERE NEEDED AT THIS TIME AND TO CONTINUE MAKING THE MODIFIED TRIAL PAYMENT ” Vicki states there was no reason the package should not be in correspondance with processor for underwriting and looked complete. I was advised by MHA to call back & verify in a week.
JULY 8TH, 2010:
Called IndyMac because requirements for the “financial contribution letter” that was dismissed by Robert on June 23rd, was showing on the IndyMac website as a required document. My MHA rep was JESSE HIGGINS. Indy Mac stated that the documents WERE INDEED shown as DISMISSED and should be taken off the website no longer than JULY 23RD, AND TO CONTINUE MAKING THE MODIFIED PAYMENT, and THAT NO OTHER DOCUMENTS WERE NEEDED AT THIS TIME.
AUGUST 10TH, 2010:
The request for the contribution letter was STILL on Indy Mac website and it was past July 23rd, meaning packet was STILL not complete. MHA rep was ALINA GUITERAZ who called Indy Mac. We were told AGAIN that it was showing as NOT NEEDED and would be taken off website, but what was NOW needed was a new 4506T form. We were assured multiple times during this phone call that this was “absolutley the last thing needed to complete our package” and then it would be sent to underwriting for processing and we would see if our trial loan (THAT WE NOW HAD BEEN PAYING SUCCESSFULLY FOR 7 MONTHS) would be made permanent, WE WERE TOLD TO CONTINUE PAYING MODIFIED AMOUNT AND NO OTHER DOCUMENTS BUT THE 4506T FORM WERE NEEDED AT THIS TIME.
I was advised by the MHA rep to call back to ensure they received the updated 4506T document and the package was deemed complete.
AUGUST 13TH, 2010:
I sent the 4506T document registered certified mail. (because if you fax them, I had come to learn, they will just claim they never received them…)
AUGUST 18TH, 2010
Received notification from Us Postal Service that it was signed for and received.
AUGUST 24TH, 2010:
Received a letter from Indy Mac stating they STILL needed our updated 4506-T form. They also STILL stated they needed the “financial contribution letter” from our renters which, again, had been originally dismissed on JUNE 23RD, And had been verified dismissed on JULY 8TH, AND AUGUST 10TH. THIS LETTER SAID NOTHING ABOUT NEEDEING BANK STATEMENTS AGAIN TO PROVE RENTAL INCOME.
SEPTEMBER 1ST, 2010
Called IndyMac. MHA Rep was TIMOTHY KNIGHT who spoke with TRAVIS at Indy Mac.
TRAVIS CONFIRMS they HAD received our updated 4506T form and that indeed the “financial contribution letter” was NOT NEEDED. But NOW they wanted more bank statements. Completely frustrated, because we were just told nothing was needed but the 4560T form, we agreed to resend our bank statements. THERE WAS NOTHING MENTIONED OF A DENIAL DURING THIS PHONECALL.We tried to upload their requests immediately, THAT SAME EVENING, on the Indy Mac website, but the website said we had already been DENIED for the loan modification and that they WOULD NOT ACCEPT OUR DOCUMENTS!
A letter dated AUGUST 30TH, 2010, which meant it was dated the day before this phone call even happened, stated we were denied FOR OUR HAMP LOAN MOD because we did not send in our bank statements on time.
SEPTEMBER 13TH 2010:
WROTE A LETTER TO THE STATE OF CALIFORNIA DEPARTMENT OF JUSTICE ATTORNEY GENERAL EDMUND GARY BROWN JR. (not knowing what else to do at this point)I WROTE TO HIM REGARDING THE DENIAL..
I RECEIVED A LETTER BACK FROM THE ATTORNEY GENERAL STATING THEY WILL WRITE TO INDYMAC AND REQUEST A RESPONSE.
SEPTEMBER 14TH, 2010:
Called IndyMac in state of pure panic and frustration over denial. I explained that we were not even told about the bank statements until September 1st, that the denial letter was dated AUGUST 30TH, and that I had a letter dated AUGUST 24TH, stating the ONLY THING needed was the 4506t form which I knew they received on AUGUST 18TH. And again I explained we were told on June 23rd, July 8th, August 10th, and AUGUST 24TH via documented phone calls that no OTHER documents were needed, THAT THE CONTRIBUTION LETTERS HAD BEEN DISMISSED SINCE JUNE 23RD, so how does this denial over documents make any sence?
All I was told was that I was welcome to write a “dispute letter” regarding our denial.
SEPTEMBER 15TH 2010:
Making another call through MHA to IndyMac very next day in last attempt. Wanted to see if we could get original supervisor on the phone, ROBERT BELPANE, who OK’d everything way back on JUNE 23RD in the first place…
RUBY, Rep for Indymac, suprisingly informed us that our package was sent in for a ,”2nd review IN HOUSE LOAN MODIFICATION” after being denied the HAMP LOAN MOD due to the UNRECEIVED DOCUMENTATION. Ruby said to call back Friday for the results of the 2nd review. AND CONTINUE TO MAKE THE MODIFIED PAYMENT AMOUNT UNTIL WE HEAR THE ANSWER ON THE IN HOUSE LOAN MOD.
How exhausting is this story, I am sorry to report it gets Worse, HERE WE GO…..
AFTER HANGING UP WITH RUBY AT INDYMAC, THE MHA REPRESENTATIVE WHO ALWAYS STAYS ON THE LINE AFTER YOU HANG UP WITH THE MORTGAGE COMPANY, SAIS SHE JUST REALIZED WE SHOULD HAVE NEVER EVEN BEEN CONSIDERED, OR EVEN GIVEN, A TRIAL LOAN MODIFICATION UNDER HAMP IN THE FIRST PLACE BECAUSE OF OUR LOAN EXCEEDING THE RECOMMENDED AMOUNT OF $729,450.000. , AND THEY DIDN’T KNOW HOW ANYONE HADN’T EVEN REALIZED THIS IN THE FIRST PLACE INCLUDING ALL OF THEIR OWN REPRESENTATIVES! So now, I couldn’t even dispute the denial for the HAMP LOAN modifiacation that we have been on a trial for, PAYING FOR & SUBMITTING DOCUMENTS FOR SINCE OCTOBER 2009, because we NEVER qualified for one in the first place..
I asked if I could be mailed all of the records of the phone calls that were documented up to now since MHA couldn’t assist me anymore, but they said they do not do that.
SO STAY WITH ME NOW, AT THIS POINT IT SEEMS OUR ONLY HOPE OF GETTING A LOAN MOD IS THROUGH INDY MACS “IN HOUSE PROCESS”

I was told during this phone call that we should know by the end of the week.
SEPTEMBER 20TH, 2010:
Received letter dated SEPTEMBER 16TH that our In House Loan modification was now assigned to the Loss Mitigation Department and NO DOCUMENTS ARE NEEDED AT THIS TIME AND IT WAS EXPECTED TO BE COMPLETED WITHIN 30 DAYS
OCTOBER 10TH, 2010:
Actually Received a response letter dated OCTOBER 5TH, 2010, from DANIEL MANDICK of Indy Mac, a Default Escalation Specialist, regarding my letter to the Attorney General. He provided chronology of events leading to denial of hamp due to documents but of coarse none of the chronology included all of the phone calls documented where requests were dismissed etc…HE WAS NOW REQUESTING US TO REAPPLY FOR THE HAMP LOAN MOD (which we never qualified for one in the first place) BY PROVIDING A NEW MODIFICATION AFFIDAVIT, NEW PROFIT AND LOSS STATEMENTS, PROOF OF OCCUPANCY INCLUDING UTILITY BILLS, 2009 W2″S, 2009 TAX RETURNS, CONTRIBUTION LETTERS FROM RENTERS, NEW RENTERS AGREEMENTS AND 2 MONTHS OF RECENT BANK STATEMENTS.
I could not believe what I was reading….
In this letter from Daniel Mandick, it stated if I had any questions to contact the Loan Resolution department at 1-877-908-4357. I called this number & got an automated response stating THAT NO DOCUMENTS WERE NEEDED AT THIS TIME AND THAT OUR LOAN MOD APPLICATION WAS IN LOSS MITIGATION AND TO PLEASE GIVE THEM 30 DAYS TO CONTACT US.
He also stated in his letter that I could contact him DIRECTLY at 1-512-250-2787. I have called him MULTIPLE TIMES (probably at least 10 times) to ask him how ON EARTH can all the information be so contradicting. I was hoping to finally get some solid answers and explanations at this point…But what a surprise, I have not once received a response to ANY of my multiple calls to Daniel ManDick regarding my letter to the Attorney General Department of Justice.
SO LETS CONTINUE…..
OCTOBER 14TH, 2010:
We get a letter STATING THAT OUR LOAN WAS IN SERIOUS DEFAULT NOW AND REQUESTING WE PAY OVER $33,000 dollars by November 15th 2010. We were only originally 2 months behind and have been paying the payments they had asked us for on time ever since, where did this high amount come from?I Called IndyMac right away. I was told that this was, THE DIFFERENCE BETWEEN THE TRIAL LOAN AMOUNT OF $2418 AND THE ORIGINAL LOAN AMOUNT AT $5200 AND BECAUSE WE WERE DENIED THE HAMP LOAN MOD (THAT WE SHOULD HAVE NEVER EVEN BEEN OFFERED IN THE FIRST PLACE, BECAUSE OUR LOAN AMOUNT DOES NOT QUALIFY…AND WERE DENIED FOR DOCUMENTS THEY DIDN’T EVEN ASK FOR TILL THE DAY AFTER THE DENIAL WAS DATED…), WE NOW OWED THEM ALL OF THE BACK PAY FOR THIS DIFFERENCE THAT HAS ACCUMULATED WITHIN THE LAST YEAR OF PUTTING US THROUGH THIS.
But then Ruby from Indy Mac proceeds to tell me that this is just a “computer generated letter” that automatically goes out when you are denied for the HAMP LOAN mod, but not to worry, we were still being considered for the “In House” Loan mod, SO WE WERE TOLD TO DISREGARD THIS LETTER. She also assures me that she would put in a “work order” to try and hurry our answer along. She told us to keep paying the MODIFIED LOAN AMOUNT, and call back within a week regarding our status, At this point I requested original documents offering us the trial loan so I could see if we had any incling to such a request, and also the document reassuring me that we are still in loss mitigation for a loan mod and NOT in default, and also requested the note for the deed.
Received note for the deed, but have never recieved any other documentation requested, although it was requested in MORE future phone calls.
OCTOBER 25TH, 2010:
Called regarding status of In House Loan Mod, told we should know in a week,THAT NO DOCUMENTS WERE NEEDED, TO CONTINUE MAKING TRIAL PAYMENT UNTIL WE HAVE OUR ANSWER, AND DISREGARD ESCALATING DEFAULT LETTERS, AS THEY ARE ONLY COMPUTER GENERATED AFTER A “HAMP” DENIAL.

Please note, we had still never missed one payment of the trial amount we were told to pay….EVER!
NOVEMBER 22ND, 2010:
Called regarding status of In House Loan Mod, was told I should have been paying the full loan payment of $5200 ever since we were denied the hamp loan mod! I WENT POSTAL AND SCREAMED. How in the Heck can everyone give me such conflicting information!?!?!?
DECEMBER, 2010:
Contacted by Nick Lopez from Loss mitigation Department with Indy Mac, PHONE # 1-512-918-7634.
Nick asked us to prepare ALL OF OUR DOCUMENTS ALL OVER AGAIN….meaning more profit and loss statements, renters agreements, bank statements, hardship letters, monthly finances, monthly expenses ETC… We faxed him EVERYTHING .
Nick Lopez called after receiving documents and asked to refax it. I put our rental income on the same page as our business income and because my profit and loss was dated July ist through Dec, 1st 2010 and he said it should say July 1st through November 30th of 2010 instead.
DECEMBER 13TH, 2010
I complied, and re-faxed documents and followed up the next day with a phone call ensuring he received them. Never heard back from him after 2 more phone calls regarding this.
DECEMBER 15, 2010
(2 days after faxing the new info, which implies to me that we were going to be denied from the get-go) received letter that we were OF COURSE DENIED THE IN HOUSE LOAN MOD. It lists criteria that needs to be met, when I read those criteria, we absolutely meet all the criteria, I have called to find out which one they believed we have not met, have left a message every day receiving no phone call back from Nick Lopez in the Loss Mitigation department
DECEMBER 23RD, 2010,
Husband calls IndyMac to find out payment thay are expecting now sincee denied the In House Loan Mod. We had never missed the trial payment they had asked for, we have not missed a payment one month since March of 2010, I had a realtor friend of check to see if we were in default and she said there was no record of default as of 2 weeks ago. WE WERE PREPARED TO PAY OUR ORIGINAL AMOUNT …BUT, on this day my Husband was told INDYMAC/ONEWEST would not take our payments because we are $47,000 in default DUE to the difference between the trial loan amount and the original loan amount THEY OFFERED. We were told we are now in foreclosure and have to pay t$47,000 that the “trial loan mod” set us back.
WE DID NOT HAVE A CHRISTMAS, I SPENT CHRISTMAS PREPARING THIS STATEMENT SO WE COULD START ATTACKING ON MONDAY DECEMBER 27TH.
I have been told by people in the business this is COMPLETELY AND UTTERLY IMPOSSIBLE AND CORRUPT and to not give them another dime! To put that money toward a lawyer instead. I have read about people actually paying the default and Indy Mac still finding a loop hole to foreclose on their home. Taking even MORE of their money before kicking them out on the streets. We have not received any notice of foreclosure in the mail whatsover, The default letters that we received, we were told by Indymac TIME AND TIME AGAIN to disregard,that we were not in default and that this was a computer generated letter..Ruby at Indy Mac once said to me, “how could you be in default if you have never missed a payment?’ ..MY THOUGHTS EXACTLY!!!
I talked with Shauna in Congresswomans Jackie Seiers office who handles these type od cases, she asked me why we were denied the In House Process, at that point I didn’t know.

Called Indy mac, spoke with Valerie. I aske for a supervisor and was given Trish at extension 26T. I asked why we were denied the In House Loan Mod process, the answer from both her and Valerie before her was, OUR INVESTOR DOES NOT PERMIT LOAN MODIFICATIONS ON YOUR TYPE OF LOAN PERIOD, AT ALL. I asked, “so you are telling me we went through close to 2 years of this for 2 Loan modifications that we knowingly from the get go never even had a chance at? Obviously she had no reasonable answer to this. I asked how long we had to pay the default to reinstate the loan, she said 30 days from this phone call but that I had to call back in 3 days to get the official reinstatement amount.
I had a friend who is a lawyer and in the middle of a lawsuit with them, check the San Mateo County Clerks office. She said there was no record of default yet, and that by law we have 120 days, meaning was I given false information again? sHE OFFERED A REPAYMENT PLAN OF $42,000+ UP FRONT AND WOULD GIVE US 3 MONTHS TO PAY THE REMANING $3000. Which to me sais you can either jump off the Golden Gate or the Bay Bridge, you choose…
THE CONCLUSION TO THIS STORY IS THIS: WE WERE UNDOUBTEDLY FORCED INTO THIS LARGE DEFAULT. WE WERE FORCED INTO IT ON THROUGH A BOGUS HAMP “THREE MONTH” TRIAL LOAN MODIFICATION THAT DRAGGED US OUT FOR A YEAR. A HAMP LOAN THAT WE NEVER BEEN OFFERED IN THE FIRST PLACE DUE TO THE AMOUNT OF OUR LOAN.

I really am sorry that you have gone through all of this while trying to get assistance from Indymac/One West. It is especially a desperate time being that your heart and soul is engraved in your home since your husband built it himself. I do completely understand. I want you to first of all see exactly where you stand as far as the guidelines are concerned for your financial situation. Make sure that the numbers make sense before you fight on. I have forwarded your information to a higher up at One West. I want you to overnight, and fax this detailed letter, after, you take a moment to take a deep breath and call in the HOLY SPIRIT for strength and support and intercession to anyone you speak or write to. I want you to cc every government official you can think of including Congressman, Senator, Governor, Attorney General, Phyllis Caldwell treasury, Sheila Bair, FDIC. You need to be empowered with the right information FIRST, know that your numbers are accurate and fit in with the programs, IE if the numbers are off and they have to forgive principal, it probably will not happen- so make sure! Give it all you’ve got but with a new inspired grace, confidence and belief that you will succeed. I hope this helps – please read every article and also the comments on this site, there is so much valuable information available here to you – there are others that had Indymac and succeeded after following all of these steps. Please let us know the progress.

Oh, it says once i give them an online estimate of my home and any other changes, and if the test NPV they run is positive, I will have to then pay $200 and then I have to pay for a formal appraisal to be done. If the test comes back good and the appraisal is at that amoutn, that means I’d be approved?
